TERMS AND CONDITIONS
Thank you for choosing Above All Construction & Property Management, LLC as your chosen supplier for your dumpster (container) rental needs. From here forward, all dumpsters will be referred to as “containers.”
Customer agrees to the following:
1. Customer is requesting Above All Construction & Property Management, LLC to place a rented container on their property. Delivery, drop off and/or pickup of a container involves both foreseeable and unforeseeable risks for damage to the property. Understanding these risks, customer has directed Above All Construction & Property Management, LLC to place and/or pickup rented container(s) on their property. Customer acknowledges that the vehicles used to drop off and retrieve the container(s) may cause damage to driveway, lawn, landscaping subsurface equipment and utilities including, but not limited to, sprinklers, piping, drains and tiles.
2. Customer expressly releases Above All Construction & Property Management, LLC from any claim for defect or damage caused directly or indirectly by delivery, drop off or retrieval of the containers including water/rust residue. Customer further agrees to indemnify Above All Construction & Property Management, LLC for cost, damages, and attorney fees in the event a claim is brought against Above All Construction & Property Management, LLC which related in any way to the delivery, drop off, or retrieval of any container in a paved or unpaved area on the customer's property.
3. Customer is to inspect the condition of the container upon delivery and immediately report any damages to the delivery personnel at the time the container is placed on the customers property. Any damage to the container(s) while in the customer's possession, shall be the responsibility of the customer. This includes fire, theft, damage to the doors, damage to the welding, paint, etc.
4. Customer acknowledges that they cannot move or have anyone move any container without Above All Construction & Property Management, LLC’s express written permission or assistance. In the event a customer would like a container moved, customer agrees to contact Above All Construction & Property Management, LLC and schedule an appointment to relocate the container on the property. Customer further agrees that Above All Construction & Property Management, LLC will charge customers credit card on file a $100.00 container moving fee.
5. Above All Construction & Property Management, LLC has the right to enter the property where the container is located for the purpose of delivery and pickup.
6. Customer agrees to provide unobstructed access on the day of delivery and on the day of pickup. Above All Construction & Property Management, LLC will make every reasonable effort to deliver and pick up containers at the scheduled time. In the event Above All Construction & Property Management, LLC cannot make a reasonable delivery or pickup due to obstructions, customers credit card will be charged an attempt fee of $150.00 per occurrence.
6. Customer cannot put any waste materials into rented containers that are not permitted. Customer cannot, under any circumstance put the following items into the rented container: hazardous or prohibited wastes such as gas/fuel, oil, antifreeze, paint, asbestos, chemicals (pesticides, fertilizers, cleaning products, mercury containing items, pool chemicals, turpentine, weed killers, etc.) municipal waste, contaminated waste or soil, incinerator ash, septic waste, sewage sludge, batteries, etc. Customer will be responsible for all liability associated with hazardous waste being deposited into any Above All Construction & Property Management, LLC’s containers while in the customer's possession. This includes any cost associated with the cleaning/removal of such chemicals from Above All Construction & Property Management, LLC’s property, private property, and public property. Property includes, but is not limited to the following: dumpsters, vehicles, trucks, and employee’s clothing, boots, or uniforms. A minimum charge of $250.00 will be imposed as additional charges.
7. The following items require additional disposal fees, which require added l handling when disposing of the items in the containers. Some counties do not allow the disposal of certain items. These items include, but not limited to, electronics, appliances, Tv’s, tires, etc. and must be returned to the customer, which will require a $100.00 surcharge for the return of these items. Counties that do allow these items will result in added cost to the customer at $35.00 per item. We ask that special items are placed in the dumpster last and on top so we can take the responsible step to be compliant at the time of disposal. If you are not sure about an item, we ask that you call our customer service department at 862-444-5544 for clarification and any additional fees associated with these items.
8. Customer shall observe and not go over the fill line on the side of the container. Above All Construction & Property Management, LLC will not be able to retrieve a container if the waste protrudes from the top of the container. Customer is responsible for removing any materials that are over the fill line before container can be retrieved. In the event a container cannot be moved due to overfill or excessive weight (in the event the container is too heavy to be loaded onto truck), customer's credit card will be charged $250.00 for each pickup attempt. If the container is too heavy to pick up, we will need the customer to reduce the weight. In some cases, we may need to deliver a second container. Customer will be responsible for removing product from the first container into the second container. Customer will be charged a full rate for a second container rental for a legal and compliant pickup. If a customer does not balance their load, Above All Construction & Property Management, LLC will charge a customer $250 per hour to balance the load weight in addition to the extra container rental fees and any tonnage overage fees.
9. If Customer cancels delivery within 24 hours of scheduled delivery date, customer will be subject to a $100.00 scheduling adjustment charge. Any cancellations made prior to 24 hours of delivery date customer will receive a full refund. Customers requesting priority deliveries or pickups are subject to an additional $175.00 charge.
10. All container rental agreements include delivery, pickup, and disposal for a 4-day container rental. There is a $25.00 per day charge for each day after the 4-day rental agreement. Customer's credit card on file will be charged this fee each day. Above All Construction & Property Management, LLC reserves the right to pick up the rented container after 10 days.
* Credit cards will be charged the full price of the container rental prior to container delivery date and charged the tipping charges day of pickup, including any overage fees. We will notify customer of any additional charges by phone/email/text, due to prohibited items in dumpster after disposal.
